The need to take into account data privacy risks in investigations is not new; processing data about individuals, especially in a cross-border context, has, for many years, raised thorny questions at the crossroads of privacy, employment and criminal laws to name a few. However, in recent years, the spread of data localization requirements or increased complications around access to data, combined with the focal point given to privacy compliance in the context of settlement procedures, mean that data privacy and protection laws can present significant risks and potential disruptions for companies.

Navigating regimes that appear to be imposing (or actually impose) conflicting obligations place companies in difficult situations.
